These Terms of Service (“Terms”) govern your access to and use of the services provided by Ascendia Channel Partners Limited, trading as MindPath (“MindPath”, “we”, “our”, or “us”). By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree, you must not use our services.

MindPath is an online mental health clinic that specialises in ADHD, ASD (Autism), Dual, and other associated assessments, diagnosis, and aftercare services. MindPath does not provide emergency medical services, and our platform is not suitable for cases of severe ADHD and ASD (Autism) or ADHD and ASD (Autism) with significant comorbidities that require more intensive clinical support.

2. Eligibility and Scope of Services

 

2.1 Adult Clients (18+)

For adult services, you must:

  • Be at least 18 years old;
  • Have legal capacity to enter into a binding contract;
  • Provide accurate and complete information.

 

2.2 Children & Adolescents (Under 18)

MindPath provides certain services to children and adolescents under the age of 18, subject to the following conditions:

  1. Parental/Guardian Consent Required
    A parent or legal guardian must:

    • Provide informed consent prior to any assessment or consultation;

    • Accept these Terms on behalf of the minor;

    • Be legally responsible for all decisions relating to the booking and engagement of services.

  2. Legal Responsibility
    The parent or legal guardian:

    • Is the contracting party for the purposes of these Terms;

    • Accepts financial responsibility for all fees;

    • Warrants that they have lawful authority to consent on behalf of the minor.

  3. Age-Specific Suitability
    Certain services may only be available for specific age ranges. MindPath reserves the right to determine clinical suitability based on developmental stage and presenting concerns.

  4. Right to Refuse Service
    We reserve the right to decline or discontinue services where:

    • Appropriate parental authority is not established;

    • There is disagreement between guardians that cannot be resolved;

    • The service is deemed clinically unsuitable.

 
2.3 Our Adult Services

We provide:

ADHD

  • Pre-Assessment: An online self-reporting tool offering an initial recommendation.
  • Clinical Assessment: A 90-minute video consultation with a clinical psychologist to determine an ADHD diagnosis.
  • Diagnostic Report & Consultation: A 30-minute follow-up session, including a detailed diagnostic report.
  • Aftercare Services: Including psychotherapy, coaching, and psychiatric consultations where applicable.

 

ASD (Autism)

  • Pre-Assessment: An online self-reporting tool offering an initial recommendation.
  • Clinical Assessment: A 120-minute, 2-part video consultation with a clinical psychologist to determine an ASD diagnosis.
  • Diagnostic Report & Consultation: A 30-minute follow-up session, including a detailed diagnostic report.
  • Aftercare Services: Including psychotherapy where applicable.
 
2.4 Our Child & Adolescent Services

We provide:

ADHD

  • Pre-Assessment: An online self-reporting tool offering an initial recommendation.
  • Clinical Assessment: A multidisciplinary online assessment that takes place over 2 distinct video sessions, informant information, scales and a QbCheck.
  • Diagnostic Report & Consultation: A 30-minute follow-up session, including a detailed diagnostic report.
  • Aftercare Services: Including psychotherapy, coaching, and psychiatric consultations where applicable.
 
2.5 Exclusions & Limitations

MindPath is not suitable for:

  • Emergency medical situations.
  • Severe ADHD or ASD (Autism) requiring complex multi-disciplinary care.
  • ADHD or ASD (Autism) with significant psychiatric comorbidities, including but not limited to severe mood disorders, psychosis, or substance abuse issues.

 

Clients requiring these services should seek appropriate specialist care.

 

3. Booking, Payments & Cancellation Policy

3.1 Payments & Appointment Booking
  • Appointments must be booked in advance through our scheduling partner, Acuity Scheduling.
  • All payments are processed securely and card information is retained via Stripe.

 

For clients under 18:

  • Bookings must be made by a parent or legal guardian.

  • The booking party confirms they have lawful authority to act on behalf of the minor.

 
3.2 Payment Terms
  • Payment for all services must be made in full at least 5 working days before appointments.
  • MindPath reserves the right to automatically charge your designated payment method up to five (5) working days prior to the scheduled commencement of services, in the event that payment has not yet been received.
 
3.3 Cancellation & Refunds
  • Appointments may be cancelled or rescheduled without penalty if done at least 48 hours before the scheduled time.
  • Cancellations made within 48 hours of an appointment are non-refundable.
  • Refunds are processed to the original payment method within 7-10 business days.

 

4. Confidentiality & Data Protection

4.1 General Confidentiality & Data Protection Policy

  • MindPath complies with the General Data Protection Regulation (GDPR) and Irish Data Protection laws.
  • We retain personal client data only for the purpose of providing assessments and ongoing care.
  • All clinical and personal data is stored securely and accessed only by authorised personnel.

4.2 Children & Adolescents

For clients under 18:

  1. Parental Involvement
    Clinical information may be shared with a parent or legal guardian as part of the assessment process.

  2. Best Interests of the Child
    Where appropriate, clinicians may exercise professional judgment regarding confidentiality, particularly for older adolescents.

  3. Safeguarding Obligations
    MindPath clinicians are mandated to act in accordance with Irish child protection legislation. If concerns arise regarding the safety or welfare of a minor, we may report these concerns to relevant authorities.

  4. Limits to Confidentiality
    Confidentiality may be limited where:

    • There is a risk of serious harm;

    • There are child protection concerns;

    • Disclosure is required by law.

 

5. Client Responsibilities

Clients must:

  • Provide accurate and complete information during the assessment process.
  • Use the services solely for personal healthcare purposes.
  • Not record or distribute any session materials or consultations.

Misuse of services may result in immediate termination of access.

6. Limitation of Liability

  • MindPath provides assessments and reports based on clinical expertise. However, we do not guarantee specific outcomes.
  • We are not liable for technical disruptions, misinterpretation of our advice, or actions taken by third-party service providers (e.g., Stripe, Acuity Scheduling).

7. Amendments to These Terms

We may modify these Terms at any time. The updated Terms will be posted on our website, and continued use of our services constitutes acceptance of the changes.

 

8. Safeguarding & Child Protection

MindPath is committed to safeguarding children and vulnerable individuals.

We operate in accordance with:

  • Children First Act 2015;

  • Irish child protection guidance;

  • Professional ethical standards.

Where safeguarding concerns arise, we may:

  • Pause or discontinue assessment;

  • Communicate concerns to relevant guardians where appropriate.
